This website is operated by GETRIVA LLC under the Treadnite brand. Throughout the site, the terms “Treadnite,” “we,” “us,” and “our” refer to GETRIVA LLC.

GETRIVA LLC operates this store and website, including all related information, content, features, tools, products, and services made available through treadnite.com (collectively, the “Services”). The Services are powered by Shopify.

These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not access or use the Services.

SECTION 1 - ACCESS AND ACCOUNT

By using the Services, you represent that you are at least the age of majority in your state of residence or that you are using the Services with the involvement and permission of a parent or legal guardian.

You may be asked to provide information such as your name, email address, billing information, payment information, and shipping address. You represent that all information you provide is accurate, current, complete, and authorized.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.

We may suspend or restrict access to an account when reasonably necessary to protect customers, prevent fraud, enforce these Terms, or protect the Services.

SECTION 2 - OUR PRODUCTS

Treadnite sells graphic apparel, including T-shirts and hoodies. Treadnite sells handcrafted baby apparel and accessories, including knitted and crocheted garments.

We make reasonable efforts to describe and present our products accurately. Product images may include digital mockups, studio images, and lifestyle presentations. Colors, artwork scale, artwork placement, garment shape, and other visual details may appear differently depending on screen settings, lighting, garment size, fabric construction, printing methods, and normal production tolerances.

Minor differences between a product preview and the finished item do not automatically mean that the item is defective.

Product descriptions, designs, prices, sizes, colors, and availability may change without notice. We may limit quantities, discontinue products, or decline to offer a product in a particular location.

You are responsible for reviewing the product description, garment type, selected design, color, size, quantity, measurements, materials, and care instructions before submitting an order.

Because products are made to order, selecting the wrong size, color, style, design, garment type, quantity, or product does not qualify for a free replacement, exchange, or refund unless otherwise required by applicable law or expressly stated in our Refund Policy.

SECTION 3 - ORDERS

When you submit an order, you are making an offer to purchase. We reserve the right to accept, decline, limit, or cancel an order, including when we reasonably suspect fraud, unauthorized payment, resale activity, pricing errors, inaccurate information, production limitations, or policy violations.

An order confirmation acknowledges that we received your order. It does not guarantee acceptance or confirm that production has begun.

Payment must be authorized before an order can be accepted for production. If we cancel an order after payment has been collected, the applicable amount will be refunded to the original payment method.

Review your order carefully before submitting it. Because products are made to order, an order may no longer be changed or cancelled after production begins.

Returns, refunds, replacements, cancellations, and order issues are handled under our Refund Policy.

Purchases are intended for personal or household use and not for unauthorized commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts, shipping offers, and promotions may change without notice. The amount charged will be the price shown at checkout when the order is placed, subject to correction of obvious pricing or technical errors.

Unless otherwise stated, prices are displayed in United States dollars and do not include applicable taxes, shipping, or handling charges.

Promotions may be subject to eligibility requirements, minimum order values, product exclusions, expiration dates, geographic limits, and other conditions. If promotion terms conflict with these Terms, the specific promotion terms control for that promotion.

You agree to provide current, complete, and accurate billing, payment, shipping, and contact information. You represent that you are authorized to use the payment method submitted and that the payment information is accurate.

We may use third-party payment providers to process transactions. We do not ask customers to send complete payment card details by email or social media.

SECTION 5 - SHIPPING AND DELIVERY

Treadnite currently ships to addresses within the United States, Canada, Australia, and select countries in the European Union. Available destinations may change without notice; the destinations available to you will be shown at checkout.

Products require production and processing before shipment. Processing and delivery dates are estimates and are not guaranteed.

Customers are responsible for providing a complete and accurate shipping address. We cannot guarantee that an address can be changed after production or fulfillment begins.

Products in the same order may be produced at different facilities and may arrive in separate packages.

If we learn that we cannot ship within the stated timeframe, we will provide any delay notice, cancellation option, or refund required by applicable law.

Complete information about production, shipping rates, tracking, split shipments, delayed packages, lost packages, packages marked as delivered, and incorrect addresses is available in our Shipping Policy.

SECTION 6 - RETURNS, REFUNDS, AND CANCELLATIONS

Return requests must be submitted within the timeframe and under the conditions stated in our Refund Policy.

Products must not be returned without prior authorization and return instructions from Treadnite Customer Support.

Customers may be required to provide an order number, a description of the issue, photographs of the product, and photographs of the shipping label.

Because products are made to order, we do not provide free replacements, exchanges, or refunds when the customer selected the wrong size, color, style, design, garment type, quantity, product, or shipping address, except where otherwise required by applicable law.

Orders may only be changed or cancelled before production begins. Submitting a cancellation request does not guarantee that production can be stopped.

Complete eligibility requirements, reporting deadlines, exclusions, refund procedures, and return instructions are available in our Refund Policy.

Customers located in the European Union, the United Kingdom, Australia, or Canada may have additional statutory return, cancellation, or guarantee rights under applicable local consumer protection law, as described in our Refund Policy. Nothing in these Terms limits those rights.

SECTION 7 - INTELLECTUAL PROPERTY

The Services and their content, including the Treadnite name, logos, wordmarks, product artwork, graphics, photographs, videos, text, designs, layouts, product names, and other brand materials, are owned by or licensed to GETRIVA LLC and are protected by applicable intellectual property laws.

You may use the Services only for lawful, personal, and non-commercial purposes.

Without prior written authorization, you may not reproduce, distribute, modify, manufacture, create derivative works from, publicly display, publish, sell, license, scrape, download, store, transmit, or otherwise exploit Treadnite content or brand materials.

Purchasing a product does not transfer ownership of, or grant a commercial license to, any artwork, brand asset, or intellectual property.

Shopify and other third-party names, logos, and marks belong to their respective owners.

SECTION 8 - OPTIONAL TOOLS

We may provide access to tools or features operated by third parties. We do not necessarily monitor, control, or endorse those tools.

Third-party tools are provided subject to their own terms, privacy practices, availability, and limitations. Your use of them is at your own risk and discretion.

New features, tools, or resources added to the Services may also be subject to these Terms.

SECTION 9 - THIRD-PARTY LINKS

The Services may contain links to third-party websites, services, or content.

We do not control and are not responsible for the accuracy, security, availability, policies, content, products, or practices of third-party websites or services.

Review the applicable third party’s terms and policies before engaging in a transaction. Questions or claims relating to a third-party product or service should be directed to that third party.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

The Services are powered by Shopify. Sales made through the Treadnite store are transactions directly between the customer and GETRIVA LLC, doing business as Treadnite.

Shopify is not the seller of Treadnite products and is not responsible for the production, fulfillment, delivery, quality, return, refund, or customer-support obligations associated with those products.

Nothing in these Terms creates an agency, partnership, employment, franchise, or joint-venture relationship between a customer and Shopify or between a customer and GETRIVA LLC.

SECTION 11 - PRIVACY POLICY

Personal information collected through the Services is handled under our Privacy Policy.

Because the Services are hosted by Shopify, Shopify and other service providers may collect and process information relating to your access to and use of the Services in order to provide, secure, support, and improve the platform and related services.

Information submitted through the Services may be shared with service providers as described in our Privacy Policy.

By using the Services, you acknowledge that you have reviewed our Privacy Policy and any applicable privacy disclosures presented through the Services.

SECTION 12 - FEEDBACK, REVIEWS, AND SUBMISSIONS

If you submit a review, photograph, video, comment, suggestion, idea, proposal, or other content (“Feedback”), you represent that you own the content or have the rights necessary to submit it.

You must disclose any material compensation, free product, discount, or other incentive connected to your Feedback when disclosure is required.

You may not submit false or misleading reviews, impersonate another person, misrepresent a purchase or product experience, use a misleading identity, or submit content that is unlawful, defamatory, abusive, obscene, fraudulent, infringing, or malicious.

By submitting Feedback, you grant GETRIVA LLC a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, display, distribute, and promote that Feedback in connection with operating and marketing Treadnite, subject to applicable law and our Privacy Policy.

We may moderate, reject, edit, or remove Feedback that violates these Terms or applicable law. We are not required to publish, compensate, or respond to Feedback.

SECTION 13 - ERRORS, INACCURACIES, AND OMISSIONS

The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, transit times, availability, or other information.

We may correct errors, update information, or cancel an affected order at any time. If an order is cancelled because of an error after payment has been collected, the applicable payment will be refunded to the original payment method.

SECTION 14 - PROHIBITED USES

You may not use the Services:

• For unlawful, fraudulent, malicious, or deceptive purposes
• To violate intellectual property, privacy, publicity, or other legal rights
• To transmit false, misleading, abusive, defamatory, obscene, or harmful content
• To impersonate another person or entity
• To distribute viruses, malware, or harmful code
• To collect personal information without authorization
• To interfere with the security, operation, or availability of the Services
• To conduct payment fraud, chargeback abuse, unauthorized resale, or account abuse
• To scrape, crawl, copy, or extract data through unauthorized automated or manual means
• To bypass security measures, access controls, rate limits, robot exclusions, or other restrictions

We may suspend, restrict, or terminate access when we reasonably believe these restrictions have been violated.

SECTION 15 - AUTOMATED AGENTS

Any software or service that accesses or interacts with the Services autonomously or semi-autonomously (“Agent”) must identify itself accurately and comply with applicable technical instructions, access controls, robot exclusions, and rate limits.

An Agent must not conceal that it is automated, mimic human behavior to bypass safeguards, complete or circumvent CAPTCHAs, or evade measures designed to limit automated access.

We may restrict or block Agent access at any time.

SECTION 16 - TERMINATION

We may suspend or terminate access to the Services when reasonably necessary to enforce these Terms, protect customers, prevent fraud or abuse, comply with law, or protect the Services.

Termination does not eliminate obligations that arose before termination, including payment obligations.

Provisions that by their nature should survive termination will remain in effect, including intellectual property, Feedback licenses, disclaimers, limitations of liability, indemnification, governing law, and privacy provisions.

SECTION 17 - DISCLAIMER OF WARRANTIES

The Services and the information available through them are provided for general informational and commercial purposes.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND EXCEPT AS EXPRESSLY STATED BY GETRIVA LLC, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, DURABILITY, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you. Nothing in these Terms limits rights that cannot lawfully be limited or waived.

SECTION 18 - LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETRIVA LLC, DOING BUSINESS AS TREADNITE, AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS.

WHERE LIABILITY CANNOT BE EXCLUDED, LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

SECTION 19 - INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless GETRIVA LLC, doing business as Treadnite, and its owners, officers, employees, affiliates, agents, contractors, service providers, and licensors from third-party claims, losses, liabilities, damages, and reasonable legal costs arising from:

• Your material breach of these Terms
• Your unlawful use of the Services
• Your violation of another person’s rights
• Content or Feedback you submit

We will provide reasonable notice of a covered claim when practicable. You agree to cooperate reasonably in the defense of the claim.

SECTION 20 - SEVERABILITY

If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted or severed as necessary. The remaining provisions will remain in effect.

SECTION 21 - WAIVER; ENTIRE AGREEMENT

A failure to enforce a provision of these Terms is not a waiver of that provision or any other right.

These Terms and the policies referenced in them constitute the entire agreement between you and GETRIVA LLC regarding use of the Services and supersede prior communications or agreements concerning the same subject matter.

SECTION 22 - ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

GETRIVA LLC may assign or transfer these Terms as part of a merger, acquisition, restructuring, sale of assets, financing, or other lawful business transaction.

SECTION 23 - GOVERNING LAW

These Terms of Service and any separate agreements through which GETRIVA LLC provides the Services under the Treadnite brand are governed by the laws of the State of Florida and applicable federal laws of the United States, without regard to conflict-of-law principles.

Nothing in these Terms limits consumer rights that cannot lawfully be limited or waived.

SECTION 24 - CHANGES TO THESE TERMS

We may update these Terms by publishing a revised version on this page.

Changes take effect when published unless a different effective date is stated. Where required by law, we will provide additional notice of material changes.

Your continued use of the Services after updated Terms take effect constitutes acceptance of the revised Terms.
